Runway Restaurants AG and Flying Catering (operation of Runway Restaurants AG)
General
Flying Catering is an enterprise of Runway Restaurants AG.
Runway Restaurants AG and Flying Catering provide comprehensive catering services to the client for their event, and in no way act as an organiser.
The organiser and therefore responsible for the proper running of the event is always the customer or their client. The organiser must endeavour to obtain appropriate insurance cover for damage to property and personal injury.
Offers and confirmation
Based on the customer's specifications, Runway Restaurants AG and Flying Catering shall submit a detailed offer to the customer regarding the catering services to be provided for their event. This offer is not binding on the customer, Runway Restaurants AG, or Flying Catering in any way.
Following any necessary adjustments to the quotation, Runway Restaurants AG or Flying Catering will confirm the order to the customer in detail. An agreement is reached once Runway Restaurants AG or Flying Catering has received back a duplicate of the confirmation, duly signed and dated by the customer.
Order amendment
If any changes are requested after receipt of the signed confirmation by the customer, the customer must sign a revised confirmation, provided that they have received one from Runway Restaurants AG or Flying Catering, and return it to Runway Restaurants AG or Flying Catering.
Changes to the number of people attending the event cannot be made in the three working days prior to the event.
Payment terms
For security reasons, we do not accept 1,000 notes as payment.
If a portion of the consumption, such as spirits, is charged to individual persons on a total bill, any outstanding balance will be invoiced to the organiser.
You are welcome to pay for your own consumption individually for groups of up to 20 passengers. However, please note that any outstanding balance will be charged to the organiser. For groups of 21 or more, the total amount must be settled with one invoice (cash, credit card, or on account).
Invoices are payable within 10 days of the invoice date, net of any deductions. In case of default, Runway Restaurants AG is entitled to charge a default interest of 5% on the outstanding amount.
Price changes due to inflation remain reserved.
Organisers with their registered office abroad who book an event with Runway Restaurants AG/Flying Catering that exceeds a consumption amount of CHF 1,000.00 must prepay the offered amount up to 14 days before the event, without deduction. Any remaining balance can be paid on site by credit card. Without the advance payment having been received, the event cannot be held.
For larger events and weddings, we reserve the right to request a deposit of 50% of the offered amount.
The advance payment must have been credited to the account of Runway Restaurants AG/Flying Catering no later than 10 days before the event.
If the advance payment is not made on time, Runway Restaurants AG / Flying Catering is entitled to withdraw from the contract without further notice or to adhere to the contract and waive the catering service, potentially claiming damages.
Cancellation and alteration of catering/reservation
In the event of cancellation of the catering/reservation, the following contribution towards expenses will be owed:
- Cancellation -180 days before date CHF 1,000.00 administration fee
- 179-90 days before due date 25 % of order volume (according to offer)
- 89-45 days before due date 50 % of order volume (as per quote)
- 44-15 days before deadline 75 % of the order volume (according to offer)
- 14-0 days before due date 90 % of order volume (according to offer)
Localities and grounds infrastructure
The client is responsible for ensuring that the premises and grounds where the catering service is to be provided by Runway Restaurants AG / Flying Catering comply with the requirements of Runway Restaurants AG / Flying Catering.
In particular, the customer must notify Runway Restaurants AG / Flying Catering in good time if access is difficult or if the building has no lift.
Furthermore, the customer is responsible for ensuring that the necessary installations (electricity, hot and cold running water) are available in a standard, usable form.
If, on the day of the event, the provision of catering services becomes difficult or impossible due to insufficient infrastructure, the customer is obliged to pay the full order value, even if Runway Restaurants AG/ Flying Catering is only able to provide partial or no catering services.
Late delivery, delays
The delivery and service times agreed with the customer are in all cases agreed as mere guidelines only. Runway Restaurants AG / Flying Catering accept no liability for delayed deliveries and delays in the running of the event.
Liability and Damages
If Runway Restaurants AG / Flying Catering provides returnable materials (glasses, crockery, cutlery, linen, etc.), the customer is responsible for ensuring that the materials are returned complete and undamaged. Losses shall be borne by the customer.
The organiser is liable for any damage to the object, furniture and decoration caused by the organiser or their participants. The attachment of items (e.g. own decoration) is only permitted after consultation with Runway Restaurants AG / Flying Catering.
Insurance, including for damage to brought items, is the responsibility of the organiser.
Billing, Payment
Following the event, the customer will receive an invoice and receipt from Runway Restaurants AG / Flying Catering, detailing the services provided (food, drinks, transport, materials, personnel, direct guest orders), VAT, any losses on returned items, and the deposit paid. The invoice is to be settled within 10 days, with no discount applicable.
In the event of default, Runway Restaurants AG / Flying Catering is entitled to charge a default interest rate of 5 %.
Copyright
It is to be assumed that the information available via the website of Runway Restaurants AG / Flying Catering is protected by copyright and that its commercial use is only permitted with the consent of the copyright holder and against payment.
Applicable law and place of jurisdiction
Swiss law shall apply. The exclusive place of jurisdiction shall be Zurich.
